Hello TMSA Community,
At The Main Street Academy (TMSA), the privacy, safety, and security of our students and their information are of utmost importance to us. In accordance with the Family Educational Rights and Privacy Act (FERPA), TMSA does not disclose or share any student information. Additionally, we prohibit student interactions with individuals or external organizations without prior parental consent, except when it is specifically related to educational and academic programs.
Recent changes in federal policy regarding immigration enforcement in schools have raised important questions about our students' rights and TMSA protocols. It is essential that we work together to ensure our schools remain safe and welcoming environments while adhering to all applicable laws and policies. To that end, I am sharing the following information to provide further guidance to protect our students and staff while upholding our school’s mission and vision.
FERPA protects all student information and records. Additionally, the Supreme Court decision in Plyler v. Doe (1982) guarantees every child's constitutional right to public education, regardless of immigration status. It is important to note that under FERPA, schools cannot release student records or personally identifiable information without parental consent, a judicial order, or a subpoena. This similar protection also applies to staff and employees.
Therefore, we do not share student or staff information—including immigration status or demographic data—without explicit parental consent or a valid court order. Our staff members receive comprehensive training to adhere to established protocols and procedures, which are designed to enhance the safety and well-being of both personnel and students throughout the school day.
